RAUE LLP achieves insight into Guttenberg documents |

RAUE LLP achieved a decision before the Administrative Court of Berlin that the Scientific Services and the Language Service of the German parliament (Bundestag) have to grant a journalist access to reports and papers requested and used by the former federal minister and member of parliament Karl-Theodor zu Guttenberg. The court decided that these areas of the federal parliaments’s administration are not excluded from the scope of the Freedom of Information Act (IFG). They also can not rely on copyright to deny the access to the file request.
The client of RAUE LLP, a journalist, had asked for access to eight documents of the Scientific Service and the Language Service of the German parliament. Karl-Theodor zu Guttenberg had requested these documents from the service facilities of the Bundestag and had used them for his dissertation. The plagiarism accusation against Mr. zu Guttenberg cannot be verified without access to these documents. The administration of the German Bundestag, however, refused access to the files stating that the IFG does not apply to those parts of the federal parliament’s administration. In addition, access to the files would violate the copyright of the Scientific Service of the documents.
The 2nd Chamber of the Administrative Court of Berlin, chaired by the President of the Court, Mrs. Erna Viktoria Xalter did not follow this view and ruled that the Bundestag must now grant access to the documents. Because of the fundamental importance of the issue, the Court granted the option to appeal to the Federal Administrative Court.

RAUE LLP advised Axel Springer AG in a legal dispute challenging the legitimacy of its copyrights arrangements with freelance journalists. This matter has now been decided by the Federal Court of Justice (BGH). In its ruling, the court in principle agreed with Axel Springer AG and upheld the legitimacy of extensive granting of rights by freelance journalists to publishers. This decision is expected to provide legal certainty not only to newspaper publishers but other media industries dealing with authors granting rights to users.

RAUE LLP achieves landmark decision for Chambers of Industry and Commerce |

RAUE LLP has successfully defended the Chambers of Industry and Commerce of Kassel and Cologne in lawsuits of some of their members. The landmark decisions are of fundamental importance to the exercise of functions of all German Chambers of Industry and Commerce.
In Kassel, a company questioned the compatibility of the mandatory membership of enterprises in German Chambers of Industry and Commerce with the German Constitution and with the Law of the European Union. The company further challenged the contribution system as well as the financial reserves of the Kassel Chamber of Industry and Commerce. However, the administrative court confirmed the mandatory membership as well as the contribution system and the accrued reserves of the Kassel Chamber of Commerce represented by RAUE LLP.
In a parallel procedure, a company sued against the decision of the Cologne Chamber of Industry and Commerce to publicly support a significant port development project. The administrative court followed the arguments of RAUE LLP and held that the Cologne Chamber of Industry and Commerce fulfilled its legal tasks and that it exercised the necessary objectivity and restraint.
